BOULDER RANCH
ACCIDENT WAIVER / RELEASE OF LIABILITY / PHOTO RELEASE
I, the undersigned participant, do hereby voluntarily consent to waive and release the Boulder Ranch, located near Temecula, CA (the “Ranch”) and its owners, officers, directors, trustees, instructors, employees, agents, independent contractors, representatives and volunteers (“Released Parties”) from any and all liability related to my involvement or participation in ranch-related activities, including but not limited to camping, hiking, climbing, bouldering, rappelling, cycling, four-wheeling, rope-swinging, gun/archery shooting, and brush-clearing, as well as the use of any equipment, facilities and/or services provided by any of the Released Parties. I further acknowledge that the Ranch includes rural, unimproved property and that ranch-related activities and use of equipment may be unsupervised.
IN CONSIDERATION of my permitted involvement in activities at the Ranch, I further acknowledge and agree that:
1) Ranch-related activities (described above) involve risk of PROPERTY DAMAGE, BODILY INJURY and/or DEATH.
2) I KNOWINGLY and FREELY ASSUME ALL SUCH RISK, and
3) I, FOR MYSELF, and ON BEHALF OF MY HEIRS, SUCCESSORS AND ESTATE, HEREBY FULLY AND FOREVER RELEASE AND AGREE TO INDEMNIFY AND HOLD HARMLESS AND CONVENANT NOT TO SUE THE RELEASED PARTIES WITH RESPECT TO ANY CAUSE OF ACTION IN ANY WAY RELATED TO MY INVOLVEMENT IN ACTIVITIES AT THE RANCH AND/OR ANY ASSOCIATED RISK AS SET FORTH HEREIN.
The foregoing is a general release and extends to both known and unknown claims.
I expressly and consciously acknowledge and agree that the foregoing waives the provisions of California Civil Code section 1542, which states that “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
In addition to the foregoing, I understand that my access to the Ranch is pursuant and subject to all posted and verbal instructions, applicable rules, and any regulations adopted from time to time by the Ranch, and I agree to comply with such instructions, rules, and regulations. I also agree to remain alert and act in a careful and prudent manner at all times while participating in ranch-related activities.
The Ranch and its owners, officers, employees, instructors, agents, and volunteers have my permission to seek whatever medical treatment may be deemed prudent or necessary in the event of an emergency.
I hereby authorize the Ranch and its owners, officers, employees, instructors, agents, and volunteers to utilize any and all photographs, digital images, videos or other likeness of me or anyone assigned guardianship to me, as they deem appropriate in the Ranch’s promotional materials, educational materials and/or web content, without compensation.
